SMS Campaign Terms and Conditions
A. SMS and MMS Text Messaging Programs:
Through the technology platform and associated services provided by Text Groove Communications Inc., third-party companies and entities (“Companies”) may engage in mobile messaging campaigns with their customers. These campaigns enable customers to subscribe to and receive messages on a wireless device via short message service (“SMS”) or multimedia message service (“MMS”), collectively referred to as “text messages.”
The frequency and availability of text messages depend on the campaign type and customer activity, as well as the preferences a customer has (or has not) set for the service. Messages will originate from the phone number or short code associated with each individual campaign (“Campaign Number”).
In connection with text messaging programs, Companies are responsible for:
- Obtaining Consent: Securing prior express written consent from customers, or relying on appropriate implied consent (e.g., for 1:1 messaging initiated by the customer).
- Content Management: Collecting customer lists, preparing message content, and ensuring the appropriate distribution of messages.
- Compliance: Adhering to all applicable laws, regulations, and guidelines, including the Telephone Consumer Protection Act (TCPA), Canada’s Anti-Spam Legislation (CASL), and carrier or wireless industry requirements regarding data privacy and message transmission.
By opting in to a campaign or engaging in a one-to-one conversation with a Company, customers consent to the following:
- They may receive recurring text messages related to the specific campaign or one-to-one interactions they initiated.
- Messages may be sent using autodial or other automated technologies.
- Consent is not a condition of purchasing goods or services.
- They confirm they are at least 13 years of age.
B. Cancellation:
Customers may cancel or opt out of receiving text messages at any time by replying “STOP” (or other recognized opt-out keywords such as “UNSUBSCRIBE,” “CANCEL,” “QUIT,” or “END”) to any text message received.
Upon cancellation, customers may receive a confirmation message to verify their opt-out request. Customers understand that unsubscribing from one campaign does not automatically unsubscribe them from other campaigns. To stop all services, customers must reply “STOP” to each Campaign Number individually.
C. Help and Support:
If customers require additional information or assistance, they may reply “HELP” to any text message received from a Company. Message and data rates apply.
For further support, customers can visit the Company’s website for additional resources.
D. Message and Data Rates:
Message and data rates as determined by the customer’s mobile service provider may apply to text messages sent or received. Companies and Text Groove Communications Inc. are not responsible for any fees incurred as a result of subscribing to or engaging with text messaging campaigns. Any charges will appear on the customer’s mobile provider bill or be deducted from their prepaid balance.
E. Privacy:
The collection, storage, and use of customers’ mobile numbers and any personal data are subject to the privacy policy of the Company operating the campaign. Text Groove Communications Inc. takes no responsibility for the Companies’ privacy practices. Customers should refer to the specific privacy policy of the Company that initiated the text messaging campaign for more information.
F. Sweepstakes and Contests:
Customers participating in sweepstakes, contests, or other promotional campaigns acknowledge that:
- Standard eligibility rules apply, including age restrictions (minimum 18 years unless otherwise stated).
- Participation is voluntary and not conditional on any purchase.
- Winners may be required to consent to the public disclosure of their name or likeness for promotional purposes, as described in the campaign’s terms.
- No purchase necessary. Full details and rules for contests or sweepstakes, including a free alternate method of entry, will be provided by the Company.
